2 indicted for Warren County killing

LEBANON, Ohio (WDTN) – The two men accused of killing a Warren County teen were indicted Monday, Feb. 24 and could face the death penalty.

Timothy Mosley and Austin Myers, both 19, were indicted on nine counts, including aggravated murder in what prosecutors say they will try as a death penalty case.

We asked Warren County Prosecutor David Fornshell why he decided to seek the death penalty in this case.

“The level of prior calculation or design that existed is what in my opinion convinced the grand jury in this particular case,” Fornshell says.

Mosley and Myers are accused of killing Justin Back, 18, inside his family’s Wayne Township home.

Investigators said the pair went to the home with the intent to rob and kill Back.

Authorities found Back’s body near a bridge in Preble County.

Both men are being held in the Warren County Jail on a $1 million bond.
