DAYTON, Ohio (WDTN) — Police arrested a man after they say he was drunk in a busy Dayton Wendy’s restaurant and refused to obey officials’ orders.
Police responded to the Wendy’s in the 1500 block of Wayne Avenue around 8:20 p.m. Saturday after employees reported a man was sleeping in a booth and they couldn’t wake him.
Clarence Lane III, 43, was arrested on charges of disorderly conduct, resisting arrest, and obstructing official business.
When officers arrived, they found Lane intoxicated and passed out in a booth. Police said they were finally able to wake him and offered to give him a ride home. Lane told them he was going to leave the restaurant. Officers warned him he was too intoxicated to be walking in public and again offered him a ride.
Police said several customers were inside the store at the time.
Lane said he was not drunk and he wasn’t sleeping.
According to the police report, Lane refused the ride, tried to walk by officers, and refused to comply with orders. An officer struggled with Lane on top of a table inside Wendy’s as another officer was trying to get Lane out of the restaurant before causing a scene. Lane and the officer went down to the ground just outside the Wendy’s door.
Lane was handcuffed, placed into a cruiser, and transported to jail.
Lane was also issued a minor misdemeanor for having a small amount of marijuana in his pocket.
