DAYTON, Ohio (WDTN) – A man with no pants was arrested in the parking lot of an east Dayton Dairy Queen Wednesday.

Police were called to the South Smithville Road store on the report of a person passed out in a van parked by the dumpster.

When officers arrived, they found 53-year-old Gregory A. Maxwell asleep in the driver’s seat, wearing nothing but a T-shirt, and in full view of anyone walking through the parking lot.

Officers woke Maxwell, who they said was highly intoxicated.

Maxwell told the police he was wearing only a T-shirt because it was “too hot to wear clothes.”

Officers managed to get Maxwell dressed and booked into the Montgomery County Jail on a charge of public indecency. provides commenting to allow for constructive discussion on the stories we cover.
