DAYTON, Ohio (WDTN) – A Montgomery County jury deliberating the sentence of convicted murderer Anthony Stargell Tuesday.
It must decide whether to recommend life in prison or a death sentence for the murder of Dayton businessman Tommy Nickels.
“You will be going back to make a decision as it relates to aggravated murder on counts one, two and three,” said Defense Attorney Dennis Lieberman.
Stargell, 27, is asking jurors to take into account what his attorney calls his mental health issues and family background as reasons to spare him of the death penalty.
Nickels was shot to death in April 2012. Prosecutors says Stargell then started Nickels’ Main Street business on fire to cover up the crime.
