Sentencing phase begins in capital murder case

LEBANON, Ohio (WDTN) – The sentencing phase for Austin Myers begins Monday in Warren County.

Justin Back was killed in Wayne Township in January. His body was found in Preble County.

Myers, 19, was found guilty of aggravated murder, kidnapping, aggravated burglary, aggravated robbery, theft of a firearm, tampering with evidence, safe cracking and abuse of a corpse.

He now faces the possibility of the death penalty.

Timothy Mosley, also charged in the case, agreed to testify against Myers in order to avoid the death penalty.

Prosecutors said Myers and Mosley went to the home with the intent to rob and kill Back.
