DAYTON, Ohio (WDTN) – A Dayton store owner will not face prosecution for fatally shooting a teenager during a robbery attempt after a Montgomery County grand jury voted not to indict.
Isiah Haggins, Jr., 16, was armed with a loaded handgun when he entered the Step-N-Style clothing store at 3217 West Siebenthaler Avenue to rob the business, Prosecuting Attorney Mat Heck Jr. said.
The storeowner, armed with his own handgun, fatally shot and killed Haggins.
Heck said after consideration of all the testimony and evidence, the grand jury declined to indict anyone on felony charges, finding that the shooting was justified.
“When someone brandishes and points a loaded handgun at a storeowner or clerk, with the intention of committing a robbery, he should understand that citizens have the right to defend themselves by using necessary force, including deadly force,” Heck said.
