DAYTON, Ohio (WDTN) – A Dayton bar must pay nearly $90,000 to settle a lawsuit over a barroom brawl.

The owners of Ned Peppers lost an appeal in court after claiming they did not get proper notice of a lawsuit filed by William Lussier. The Second Court of Appeals ruled that the bar owners did not respond to the suit.

Lussier sued after suffering injuries at the Oregon District establishment during a fight there in 2006.

The appeals court determined that although the lawsuit was dropped and re-filed, the bar had sufficient notice of the proceedings. provides commenting to allow for constructive discussion on the stories we cover.
