DAYTON, Ohio (WDTN) – Phillip Tyra has been found guilty of murder from shooting and killing 24-year-old Triston McDonald from over the summer.
Tyra was also found guilty of felonious assault, carrying concealed weapons, and trafficking in marijuana.
He was also charged but not convicted of aggravated robbery.
Sentencing will be February 8.
In Montgomery county court, Thursday, prosecutors used what Tyra originally told homicide detectives back in May of last year, against him.
While on the stand in court Thursday, he admitted to shooting McDonald several times.
“Phillip, how many times did you shoot the gun?,” asked the prosecuting attorney.
“Honestly, I have no idea. I remember the first initial shot because it was loud and it broke the silence.Bbut after that. It was like I blacked out or something,” said Tyra.
Tyra said during that moment, it was self-defense and told the courtroom, McDonald was about to rob him at gunpoint.
“I used my arm to get the gun away from my body. I pull out my gun, and I begin to shoot. I start shooting and he was struggling towards me and so I kept shooting until I felt I wasn’t in danger anymore,” Tyra said.
