Man accused of trying to assault officer outside McDonald’s

DAYTON, Ohio (WDTN) — A man was taken into custody outside of a fast food restaurant for reportedly trying to assault a police officer.

Officers were dispatched to the McDonald’s at 1070 South Smithville Road Friday around 7:30 p.m. on a suspicious circumstance. Someone called police saying a man in a red hoodie was walking in front of the restaurant yelling obscenities at passing cars.

Police said when they arrived, the man dropped the two red bags he was carrying and walked towards an officer and tried to strike him in the face. The officer blocked the punch and wrestled the man onto the hood of the cruiser and tased him.

Police said they recognized the man from a situation from a week earlier that happened in the parking lot of Kroger on South Smithville Road where the man approached police and asked if they were looking to take him to jail for murder. He reportedly said the voices in his head were telling him to kill someone. He was taken to the hospital for a mental evaluation.

Friday, the man was taken into custody.

Police collected witness statements.

Officers said due to the man’s prior mental health issues and because he was also tased, he was taken to Grandview Hospital for a mental and physical evaluation.
