Franklin man indicted in fatal Miami Twp. accident

DAYTON, Ohio (WDTN) –  A Montgomery County grand jury indicted a man from Franklin Wednesday in an August accident that killed a man changing a flat tire.

54-year-old Thomas Leonard from Franklin was indicted Wednesday on charges of aggravated vehicular homicide for an August crash that killed 41-year-old Mitchell Munoz from Troy.

Police say Leonard drove his pickup onto a shoulder of the southbound lanes of I-75 just north of SR-725 in 2015. Munoz was parked there changing a flat tire when he was struck by Leonard’s pickup truck.

Leonard suffered minor injuries.

Troopers from the Ohio State Highway Patrol said at the time they believed speed was a factor in the accident.

Leonard is due in court on June 16.
