DAYTON, Ohio (WDTN) – The fate of an accused murderer is now in the hands of a jury.
The jury deliberated until around 8:00 Friday night. The jury will reconvene at 8;30 Saturday morning.
Harvey Lee Jones is accused of killing Carly Hughley and Demetrius Buckwith in January 2013.
The week-long trial included testimony from FBI Agents, friends of the victim and arguably the most important witness — Hughley’s now-14-year-old son.
The prosecution argued that the boy saw the double murder happen, whereas the defense argued that it was a case of mistaken identity.
After a verdict is reached, the death penalty phase will begin.
The same jury who sat on the trial phase, will remain the same for the death penalty phase. They will determine whether or not the crime justifies the death penalty.
