Mother of slain toddler ruled incompetent to testify in boyfriend’s trial​

HAMILTON (AP and WLWT) — A woman who already pleaded guilty to lesser charges in her daughter’s death has been found incompetent to testify in her boyfriend’s murder trial.

Our partners in Cincinnati, WLWT, are reporting Bradley Young pleaded not guilty to charges of murder, involuntary manslaughter and child endangering in Kinsley Kinner’s death.

Authorities say crews found Kinsley beaten and unconscious at her Madison Township home in December. She died at a hospital the next day.

Prosecutors say Young beat the child to death.

Kinsley’s mother, Rebekah Kinner, was sentenced in May to 11 years in prison. She pleaded guilty to involuntary manslaughter, permitting child abuse and child endangering in her daughter’s death.

She testified for the prosecution on Thursday. But on Friday, Young’s attorney contended that the medication Kinner was on made her appear intoxicated and made her testimony invalid.

Kinner said she was prescribed Prozac and Lamictal.

Under questioning, Kinner admitted some of her answers to questions on Thursday weren’t truthful.

“I know what he did and I saw it and that’s all I want to get out,” Kinner said.

Young’s attorney made a motion to strike Kinner’s testimony and asked for a mistrial.

The judge said that sometimes someone testifies untruthfully because they have an agenda, but that Kinner doesn’t even seem to go through the process of having an agenda.
