Captain involved in excessive force case on administrative leave

DAYTON, Ohio (WDTN) – 2 NEWS Investigates has confirmed the Montgomery County Sheriff’s Captain accused of using excessive force on an inmate and covering it up has been placed on administrative leave.

According to a personnel order approved Tuesday, Captain Judith Sealey was put on paid administrative leave starting October 8th.

This comes after a federal complaint was filed on behalf of Amber Swink. Her attorney, Doug Brannon, not only is saying Swink was unnecessarily assaulted with pepper spray by Sealey while she was restrained in a chair, he also is alleging the entire Montgomery County Sheriff’s office leadership is covering it up.

“It’s not only the use of force we have an issue with, it’s the cover up of the incident. It goes to the highest levels of our sheriff’s department where documents were destroyed or hidden or buried, video was destroyed, hidden or buried,” said Brannon.

This surveillance video of the incident was leaked to the press but when we asked the Sheriff’s office for it, 2 NEWS Investigates was told they can’t find it. There was also no use of force report filed after the incident even though Captain Sealey was issued a letter of caution after the incident for not filling it out.

Captain Sealey has been employed by the Sheriff’s office for more than 20 years. She’s never had any major disciplinary action but did fail to get her annual certification and training for using pepper spray in 2003. She was promoted to Captain in February of this year.
