Family who found marijuana in their fries from Wendy’s hires attorney

DAYTON, Ohio (WDTN) – A mother who says she found marijuana in her Wendy’s french fries is now consulting with an attorney.

Dezeray Risner and her attorney Michael Wright are planning to take legal action against Wendy’s if they aren’t able to reach an agreement soon.

Risner first filed a police report back in October after her 4-year-old daughter was served marijuana with her french fries.

It happened at the Wendy’s on Brandt Pike in Huber Heights.

Since then, Risner’s daughter has been under close watch by doctors, having regular check-ups.

So far, she has a clean bill of health.

In an statement released late today, Wendy’s officials say in part:

“We have taken this situation very seriously, and have been in touch with the customer. In addition, the local health department inspected the restaurant and found no issues.”

“I’ve seen a lot of these things occur in this manner so I’m not necessarily surprised. However, marijuana is a little different than other foreign objects being found in people’s food. I would think that Wendy’s would have a better grasp on their employees,” Wright said.

To date, Wendy’s hasn’t fired any employees who were working at the restaurant at the time.

Attorney Wright says they’re waiting to for the company to wrap up its internal investigation before they can meet to discuss legal options. provides commenting to allow for constructive discussion on the stories we cover.
